1Agreement to these Terms
These Terms of Service (the “Terms”) are a binding agreement between you and JobSiteWizard (“JobSiteWizard,” “we,” “us,” or “our”) governing your use of the JobSiteWizard mobile application, website, and related services (together, the “Service”). By creating an account, or by accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
2Who can use the Service
You must be at least 18 years old and able to form a binding contract to use the Service. If you use the Service on behalf of a company or organization, you represent that you are authorized to bind that organization to these Terms, and “you” refers to that organization.
3Accounts and security
To use most features you must create an account. You can register with an email and password or with Sign in with Apple. You are responsible for the activity that happens under your account and for keeping your credentials secure. Please notify us promptly of any unauthorized use.
You agree to provide accurate information and to keep it up to date. Each individual teammate maintains their own account and is invited to the projects they work on.
4Subscriptions, billing, and renewals
Some features require a paid subscription. When you subscribe through the iOS app, payment is charged to your Apple Account and the purchase is handled by Apple under Apple’s standard terms.
- Auto-renewal. Subscriptions automatically renew at the then-current price unless you cancel at least 24 hours before the end of the current period.
- Managing or cancelling. You can manage or cancel your subscription anytime in your Apple Account settings (Settings › your name › Subscriptions). Deleting the app does not cancel a subscription.
- Pricing. Plans are billed per user. Current pricing is shown in the app and on our website and may change with notice for future billing periods.
- Refunds. Purchases made through Apple are subject to Apple’s refund policies; we do not separately process App Store refunds.
5Free trial
We may offer a free trial (for example, 14 days). Unless you cancel before the trial ends, your subscription will begin and the applicable fee will be charged to your Apple Account. Any unused portion of a free trial is forfeited when you purchase a subscription, where applicable.
6Acceptable use
You agree not to misuse the Service. You will not:
- break the law or infringe anyone’s rights while using the Service;
- upload malicious code or attempt to disrupt, overload, or gain unauthorized access to the Service or its systems;
- reverse engineer or copy the Service except as permitted by law;
- use the Service to store or share content you do not have the right to share; or
- resell or provide the Service to third parties except as expressly permitted.
7Your content and data
You retain ownership of the project information, documents, photos, and other content you submit to the Service (“Your Content”). You grant us a limited license to host, process, and display Your Content solely to operate and improve the Service for you and your invited collaborators.
8Our intellectual property
The Service, including its software, design, and trademarks, is owned by JobSiteWizard and its licensors and is protected by intellectual-property laws. These Terms do not grant you any right to our branding except as needed to use the Service.
9Privacy
Our Privacy Policy explains what we collect and how we use it. By using the Service you agree to the Privacy Policy.
10Termination and account deletion
You may stop using the Service at any time and can delete your account from within the app (Account › Delete Account). Deleting your account permanently removes your profile and personal data as described in the Privacy Policy; it does not by itself cancel an Apple subscription, which you manage through Apple.
We may suspend or terminate access if you violate these Terms or to protect the Service or other users.
11Disclaimers
The Service is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that data will always be preserved. The Service is a project-management tool and is not a substitute for professional engineering, legal, safety, or financial judgment.
12Limitation of liability
To the maximum extent permitted by law, JobSiteWizard will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, or data. Our total liability for any claim relating to the Service is limited to the amount you paid us for the Service in the 12 months before the event giving rise to the claim.
13Indemnification
You agree to indemnify and hold JobSiteWizard harmless from claims arising out of Your Content, your use of the Service, or your violation of these Terms, to the extent permitted by law.
14Governing law
These Terms are governed by the laws of the State of California, USA, without regard to its conflict-of-laws rules. The exclusive venue for disputes will be the state and federal courts located in California, unless otherwise required by applicable law. (Update this section to reflect your actual jurisdiction.)
15Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will update the “Last updated” date and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect means you accept the revised Terms.
